NEWPORT BEACH, Calif. - April 19, 2016 - PRLog -- Personal injury law firm of Bisnar Chase helped the family of a 39-year-old man obtain $1 million in a wrongful death case (Case No. VCU-262573) from a truck driver who struck and killed the victim while making a turn in the parking lot of a truck stop. The wrongful death lawsuit was filed in Tulare County Superior Court by the survivors of the decedent seeking damages for medical and funeral costs as well as lost future income and other losses.

According to court documents, the fatal accident occurred the evening of November 11, 2014 at a truck stop in the 2700 block of Blackstone Street in the city of Tulare. The report states that the truck driver was making a left turn in the parking lot when he was inattentive, failed to see the victim and struck him.

Scott Ritsema, personal injury trial attorney with Bisnar Chase, said the victim succumbed to his injuries. The truck driver, in this case, did the right thing and settled with the victim's family for the full insurance amount, which was $1 million, Ritsema said.

"We are so pleased that we could help this family seek and obtain justice woddf and fair compensation for their tremendous loss," he said. "While money cannot bring a loved one back to life, it can certainly help family members carry on with their lives and do so while enjoying a certain level of financial stability."

Ritsema also said this case is an illustration of why truck accident victims of families of deceased truck accident victims should act right away.

"It is extremely important to retain counsel in a truck accident case immediately," he said. "In truck accident cases, getting important pieces of evidence such as the truck driver's log books, cell phone records and vehicle maintenance records can be crucial. If they are not obtained right away, such critical evidence could be lost, misplaced or destroyed, putting your case in serious jeopardy. In truck accident cases, you also know that there is insurance money. So you have nothing to lose by retaining counsel."

While the truck accident portion of this case is settled, Ritsema said, the premises liability case against the owner of the truck stop is still pending.

"We found during our investigation that the truck stop where this incident occurred was poorly lit and presented dangerous conditions, which caused or contributed to this fatal collision," he said. "This is another reason to retain counsel right away because an experienced truck accident attorney will be able to identify additional defendants whose negligence could have contributed to the fatal incident."
