Reclaim Gc Has Failed In Its Campaign Waged Against Silverpoint Vacations, S.l

ARONA, Spain - Jan. 28, 2016 - PRLog -- Since 2012, the company RECLAIM GC has embarked on a sustained campaign of cold calling timeshare owners offering a legal service with a view to getting them out of their contracts signed by the companies belonging to the group “Resort Properties”, and trying to achieve a refund on the original money paid. In this campaign RECLAIM GC has deliberately included SILVERPOINT VACATIONS, S.L. in its lawsuits.

However, the Hon. Provincial High Court of Santa Cruz de Tenerife has passed its Rulings in favour of SILVERPOINT VACATIONS, S.L, categorically stating that there is no reason whatsoever why the contracts which were entered into should be declared null as, amongst other things, the purchasers were perfectly aware of what they were buying and also because they were not misled or pressurised into signing the contracts.

In fact, at today’s date, the Hon. Provincial High Court of Santa Cruz de Tenerife has passed more than fifty (50) rulings in favour of SILVERPOINT VACATIONS, S.L. and the First Instance Courts of Arona have passed more than one hundred and ten (110) rulings adopting the Hon. Provincial High Court of Santa Cruz de Tenerife’s criteria and, consequently, dismissing the lawsuits filed against SILVERPOINT VACATIONS, S.L.

However, despite the clarity with which the Courts are passing their rulings, it has come to our attention that Reclaim GC and other companies continue to convince some clients into filing lawsuits against SILVERPOINT VACATIONS, S.L.  It is obvious from this that the information that should duly be given to any person before taking legal action is being omitted. Indeed, one only has to visit Reclaim GC's website to verify that it has been omitting - with undoubtedly fraudulent intentions - the actual situation of the lawsuits filed against Silverpoint Vacations, SL.

The seriousness of this is clearly apparent if we consider the risk that the plaintiffs are being made to take inasmuch as they may be ordered to pay all the costs of the legal action they have filed. In fact, Silverpoint Vacations, SL has already begun to claim the legal costs in those cases where the plaintiffs have been ordered to pay them and the fact is that the average amount payable is in excess of 5,000€ (approx £3,000).

In view of the above, Silverpoint Vacations, SL is placing its Customer Service Department at the disposal of those clients who may be interested in being provided with all the necessary information so that they can come to a decision on whether to continue with their legal action in view of the devastating conclusions reached by the Courts in these cases."
