HOUSTON - June 16, 2015 - PRLog -- 90 days after Mr. Mata was made a victim of ineffective assistance of counsel, Raed Gonzalez with Gonzalez Olivieri LLC, undertook his cause and took his battle all the way to the Supreme Court of the United States in the case of Reyes Mata v. Lynch, Case no. 14-185, ___ S.Ct.  ___(2015).

Immigration law says immigrants only have 90 days to reopen a case after a deportation order.
If you learn that your attorney was ineffective during your representation, you only have 90 days to file to reopen your case.  Mata learned about the ineffective assistance after the time to file had elapsed.  Gonzalez argued that the time to file to reopen should be tolled for victims of the ineffective assistance of counsel.

A change that has been long overdue...

At Gonzalez Olivieri, LLC, no battle goes unfought. This case will set precedence, not only for the State of Texas, but also Mississippi and Louisiana. The 5th Circuit was the only circuit that would not recognize equitable tolling.  The legal scheme for reopening cases will now be uniform all over the U.S.  Countless immigrants will be given a second chance to fight for proper representation.  This is Mr. Gonzalez’ third win before the Supreme Court of the U.S. and the second time his precedents rework the immigration legal scheme.
