Event Synopsis: Fluid Trademarks, or more correctly Dynamic Trademarks, provide a new way to brand products. Such trademarks incorporate different permutations of shape, color, or movement that enhance consumer recognition in the marketplace, but make difficult their protection as intellectual property. The NBC peacock is one of the earliest such dynamic trademarks. Google uses hundreds of different images as a trademark to represent the company on its search engine. Such changes also present a trade-off between brand dynamism and integrity. Brand recognition helps to support dynamic trade marking in Google’s case. Hence, generally, it is beneficial for large corporations, but not for smaller ones to use dynamic trademarks. In addition, if changes are too significant, it can depart from official registration of the mark and leave it open to contestation. Dynamic trademarks generally have a short lifespan and usually do not warrant protection as registered trademarks. However, protecting a dynamic trademark really is only necessary if it is well recognized and adds value to the company. The type of IP protection thus depends on the longevity of the trademark. One solution is to register the template and change internal aspects of the mark. Copyright protection also may be useful. However, the legal terms of use of dynamic trademarks should be changed to keep apace of mark changes. But, risks remain since there is no case law on such dynamic trademarks, nor regarding their protection as IP. Holders of such trademarks should ensure that they have a good Intellectual Property strategy in protecting their entitlement.
