Strict Document Verification Stop Digital Signature Fraudulence

New Delhi, March 27, 2015:   The number of digital fraud has been extremely wider than number of reports. A digital signature fraud cases came into sight on last Friday, after reports of illegal removal of four directors of a company. The Bombay high court is hearing the case of misuse of Digital Signature of one of the directors of the company. The statutory e-filing of Income Tax return of the company can only be performed by the digital signature of one of the directors of the company. It is a mandated law to use Director’s Digital Signature while e-filing of different statutory returns including income-tax.

A class 2 Digital Signature Certificate is issued to a director of a company through which they could perform any kind of e-filing like MCA-ROC (Ministry of Corporate Affairs- Registrar of Companies) and ITR (Income-tax Return). The president of Asian School of Cyber Laws told that the misuse problem may be wider if people would not understand the importance of keeping their private key safe. The user must not disclose the private key to any authorized person generated by the Digital Signature Certificate.

Although the digital signatures are the strongest authentication techniques for online transaction over a network. The recent incident proved that the verification method used before certification is not enough. The Certifying authority must adopt some more strict and effective verification method before issuance of a DSC.

The Cyber experts and Advocates told that The Government needs to bring a strict system not only for authentication, verification and rectification but also for misuse of a digital signature in different e-filing and electronic transaction.
