Fox News Speaks with Attorney Erin Ehrlich Regarding New Ferguson Evidence

New details from the grand jury files on Ferguson have recently emerged, causing Fox News to invite Attorney Erin Ehrlich of Ehrlich, Petriello, Gudin & Plaza, Attorneys at Law to discuss the subject.
 
Dec. 10, 2014 - PRLog -- Officer Darren Wilson is reported to have not been carrying a Taser on the day he shot Michael Brown and it is this incriminating detail that is causing the public to scrutinize even more closely the grand jury’s final decision. Surprisingly, Attorney Erin Ehrlich pointed out that the jury knew about this when they chose not to convict Officer Wilson.

Ehrlich says that the Taser evidence may not impact the case in a criminal context, but it should impact future federal investigation into the Ferguson police department. She hopes that these investigations can result in agreements being reached between local law enforcement and the Justice Department for the implementation of fundamental changes.

Fundamental and positive changes within law enforcement have been called for by both President Obama and the Brown family – changes which could have a huge impact on the future safety of citizens.

When asked about Attorney General Eric Holder, Ehrlich had a great deal of valuable information to share. Holder is planning to step down and Ehrlich believes that Holder may be under pressure by the public to bring a case even if it’s not there.

She then said, “I think that many in the legal community view the recent statements by the Attorney General about these ongoing federal investigations as being more of a political gesture than an actual viable legal avenue.”

These recent statements by Holder served as a reminder to the public about the Justice Department’s ongoing independent investigations. Although his intentions were to assuage the disappointment following the grand jury decision, he may have actually created a false sense of hope that more charges will be brought against Officer Wilson.

Finally, Attorney Ehrlich briefly discussed the statements by Officer Wilson about the community that Michael Brown lived in. The Brown family’s attorney suggested that Wilson was profiling due to a racial bias in possible hopes that this would play into the federal case.

Ehrlich concluded that while these allegations are certainly being reviewed by the Justice Department, the legal burden to prove something of this nature beyond reasonable doubt is extremely difficult. The prosecution would have to show that, beyond a reasonable doubt, Officer Wilson intended to violate Michael Brown’s civil rights and right now, it just doesn’t appear to be provable.
