By: Imbesi Christensen The Honorable Henry A. Sullivan issued an award in favor of the firm's client after an in-person hearing was conducted. The decision overruled a determination by the Department of Labor that the employee was not entitled to benefits because she voluntarily separated from his employment without good cause. Specifically, the decision set forth the following: DECISION: The initial determination, disqualifying the claimant from receiving benefits…are overruled. The claimant is otherwise allowed benefits with respect to the issues decided herein. Judge Sullivan determined that Mr. Fingerhut successfully proved that the employee voluntarily separated from her employment with good cause.
