IN RE THE CASE OF ROSENBRAHN VS. DAUGAARD IN THE US DISTRICT COURTS OF SOUTH DAKOTA Amicus Larry Pressler is a moderate former member of Congress for 22 years from the state of South Dakota. He is a resident of the state of South Dakota. Larry Pressler was one of the Amici in the Supreme Court case of Hollingsworth vs. Perry, which was decided by the Supreme Court of the United States in favor of gay marriage. Amicus Pressler wishes to express support for same-sex marriage. This court should protect the fundamental right of civil marriage in South Dakota by ensuring that it is available to same-sex couples. It is Senator Pressler's view that this is a conservative position in American law since it is for civil rights. It will allow gay persons to compete equally in various activities of life. Senator Pressler arrived at his decision to support full civil rights for gays because of his extensive work with military veterans. Senator Pressler serves as a member of the Board of Directors ofJericho Homeless Veterans project. Senator Pressler believes that since gay persons are now fully accepted in the US military, they should be accorded full civil rights in our society. Senator Pressler also believes that South Dakota, with the Ellsworth Air Force Base and many international corporations and universities, will be experiencing having gay married couples being transferred into South Dakota. Senator Pressler believes it would be tragic if these employees of Ellsworth, our larger corporations, our larger universities or anyplace else were denied the right to adopt children or to buy a home or other things that normal married couples do, so there is a very practical aspect to this matter. CONCLUSION The judgment of this court should be in favor of Jennie and Nancy Rosenbrahn's plea. That is, South Dakota should allow gay marriage. The statute prohibiting gay marriage in South Dakota was narrowly passed in a referendum. It is Amicus Pressler's judgment that the mood of the public has shifted somewhat on this matter, but even if it has not, the law of the land should be to grant equal rights to the plaintiffs End
