Incredible Result in Snohomish County Accident Case Despite Prior Existing Condition

EVERETT, Wash. - April 23, 2014 - PRLog -- Attorney Rob Kornfeld announced today a significant settlement for a 48 year old construction worker seriously injured in a car accident in Snohomish County. The plaintiff was injured in a 2009 head-on collision in foggy weather when an oncoming vehicle crossed the center line and crashed into him. The accident caused significant soft tissue injuries to his neck and lower back preventing him from returning to his primary occupation.

On the eve of the trial, the Defendant's insurance company tendered an offer for $800,000, after an all day mediation, to settle the case which was complicated because of the presence of a significant pre-existing condition. Kornfeld's client had worked as a tile setter for years until low back problems put an end to his vocation. Seven years prior to the accident, the plaintiff had IDET (Intradiscal Electrothermal Annuloplasty) surgery to address ongoing pain. After the surgery, despite chronic low back problems and pain, he returned to construction work specializing in tile setting and odd jobs, and earning a modest living.

The plaintiff suffered occasional low back flare ups and received ongoing care for this pain. He had also recently sought treatment for knee pain caused from years as a tile setter, but was working without limitation just days prior to the collision. After the accident, though, he was unable to return to work despite repeated efforts to do so. The intense head-on crash caused muscle and ligament strain in his spine and bulging discs. The accident intensely aggravated his pre-existing condition making it impossible to continue working.

Attorney Kornfeld said, “As his lawyer, I was able to show that he was permanently disabled and lost his source of earnings and his vocation at the age of 48. Often, pre-existing conditions can complicate an injury case because insurance companies try and use prior injuries as an excuse not to make an appropriate settlement. Knowing this, I fought hard to get him the best result to compensate for the extensive damage - both physically and financially – resulting from this accident.”

The mediated $800,000 settlement is one of the largest soft tissue cases settled in Snohomish County ever. If you have been seriously injured in an accident through no fault of your own and have suffered debilitating results, contacting an experienced personal injury attorney is critically important. If you had pre-existing health or medical concerns and have been told this prevents you from pursuing compensation for your injuries, contact attorney Rob Kornfeld for a fresh perspective.
