MIAMI - April 8, 2014 - PRLog -- Peña v. Handy Wash, Inc. d/b/a Independent Drivers Association, Inc., et al., a lawsuit involving allegations of unpaid overtime wages and violations of the Fair Labor Standards Act (FLSA), has been filed as a collective action in federal court in Florida.  The Plaintiffs in this action, represented by Brian Pollock of FairLaw Firm, are Drivers (classified as independent contractor drivers) who claim that they did not receive proper overtime compensation for overtime hours worked.

In this putative collective action lawsuit, the Drivers allege that Handy Wash, Inc. (Handy Wash) and Zuni Transportation, Inc. (Zuni), violated, and continue to violate, the Fair Labor Standards Act (FLSA), by failing to properly compensate them for overtime hours worked.

Peña v. Handy Wash, Inc. (Case Number: 14-20352-CIV-ALTONAGA), was filed in the Southern District of Florida.  The presiding judge is Judge Cecilia Altnaga. The FairLaw Firm has just asked Judge Altonaga to certify the case as a "collective action" so that it can proceed on behalf of drivers who worked for for Handy Wash and/or Zuni within the past three years.

FairLaw Firm overtime attorney Brian H. Pollock (http://www.fairlawattorney.com), is representing the Drivers in an effort to recover unpaid wages for the overtime work they performed, but for which they did not receive the proper overtime pay.  According to a federal law known as the FLSA, non-exempt employees are entitled to time-and-a-half pay for all hours worked over forty in a given workweek.

All unpaid overtime claims filed by Drivers who currently work for Handy Wash and/or Zuni or who worked for Handy Wash and/or Zuni as drivers or independent contractor drivers within the last three (3) years anywhere in Florida, and who were not paid proper overtime are eligible to join the case.  For more information about Peña v. Handy Wash, Inc., or to join the case, please contact us at (305)230-4884 or (866)281-9288 or visit http://www.fairlawattorney.com
