Jake has been covered under the Aetna Health insurance plan that his father has as a retired New York City policeman. Now at age 15, the company has cut the hours of professional care available to Jake from 24 hours per day to just 8 hours per day, for a boy whose medical condition can make even the simplest type of medical problem a life-threatening emergency. “Jake’s condition has not changed,” states the Complaint filed by Quadrino Schwartz in New York Supreme Court this past week. “The only thing that has changed is Aetna’s appetite to save money and its desire to not pay this claim.” Jake’s parents, John and Lisa, have enlisted the help of Quadrino Schwartz, an insurance recovery law firm in New York, to take Aetna Health to court and require the insurance company to reinstate 24-hour care for their son. Quadrino Schwartz wants to ensure that the family receives the 24-hour care that Aetna’s contract requires them to provide. The Brower’s felt they had no choice but to bring this suit now, because Aetna Health keeps cutting Jake’s care. Aetna Health's latest determination eliminates nursing coverage when Jake is sick and at his worst, creating a potentially fatal situation. Harold Levy, one of the Quadrino Schwartz attorneys helping the Browers, points out that, "By providing insurance for the Brower’s, Aetna made a promise that it would be there for them when they needed coverage and benefits. We're helping to make Aetna keep its promise."
