She also said a foreclosure date has been set for February 4th, 2014. This means the homeowner and I must act quickly to get all required documents ( short sale package) submitted to BOA immediately so that the foreclosure sale date can be postponed until we successfully find a buyer for her home. Once a buyer is found and her home in under contract, BOA will most likely postpone the scheduled foreclosure sale date, allowing the homeowner to sell the home and avoid foreclosure. Also if the homeowner remains in the home until the short sale closing is complete, the lender will provide a relocation incentive up to $3,000 to the homeowner. Homeowners who has already recieved a foreclosure notification with a scheduled date should act quickly. Homeowners should be aware that if they move out of the home before the process is complete, they will not be eligible to recieve the short sale relocation incentive. The short sale process is very tedious and requires the assistance of an experience short sale broker. The entire short sale approval process can take 3-6 months and sometimes longer depending on the lender. Sellers often want to know about the tax liability assoicated with a short sale and if they will be held responsible for the deficiency and/or the outstanding loan amount the lender had to write off. In all of the short sales I have completed, not one of my sellers have had a problem with the IRS or with having to be responsible for the short sale deficiency. However, it is recommended that you consult your CPA or a tax attorney for additional information regarding this matter.
