LAS VEGAS - Jan. 1, 2014 - PRLog -- Sometimes the transfer of a timeshare deed is necessary, especially when the owner cannot afford it or decides that they don't want the timeshare. At that time the owner has the option to transfer the deed as a gift or sell it to a second party. Following are simple steps to transfering your deed:

Step 1 - How To Clear Up Outstanding Timeshare Fees

First you must check the company/resort see if you have any outstanding fees and if the company charges fees to transfer your deed. If any transfer deed fees need to be paid you will be able to determine whether the owner or buyer will be responsible for those. Any outstanding fees should be paid by the owner, because they were incurred during ownership.

Step 2 - Transfer Your Timeshare Deed

The owner should provide the buyer with the companys contact information (phone number, address), location of resort, and rules and regulations. This will provide the owner with time to research the timeshare before the transfering of the deed.

Step 3 - Transfer Your Timeshare Deed

You will need to fill out a membership transfer application, if required by the company/resort, before you can continue with the transfer of your deed.

Step 4 - Locate a Timeshare Real Estate Broker Online

Remember transfering the deed is like transfering/selling real estate. Create a contract, aka an earnest money contract, which will give more details such as the weeks the timeshare is available, if they are fixed or floating, any interest information, who pays for maintenance fees, and all other important terms of the sale. The contract should also needs to include the names, contact information and signatures of the buyer and seller.

Step 5 - File Your Timeshare Transfer Deed with Local Clerks Office

Depending on where the transfer of ownership there is most likely a deed. Contact the county clerk where the timeshare is located for a new deed on the property. Depending on what type of deed it is will determine what needs to be done and what rights you have to the property (right to use, Warranty Deed, Quitclaim deed, Bargain and Sale Deed, Cash Sale Deed, etc.). Some deeds may require that you state how much money was involved for the transfer.

Step 6 - Sell Your Timeshare Property Fast For Cash Online

Fill out the deed, have the seller and buyer sign in front of a notary public. The clerk’s website should have information on their countys process or you can call the recorder’s office for needed information. The county usually has specific requirements for recording or the deed will be rejected. ALL fees must be paid for recording the documents. Several states require a Use Fee, Sales Tax, County Fee or other fee to be paid at that time. Occassionally there may be other affidavits or tax forms with details of the dollar amount of the sale and all contact information of the buyer and seller. Now days most forms can be downloaded from the county clerks office. Make sure all forms are complete and filled out correctly or you may risk the chance of rejection, especially Florida, California, and Louisiana.

Step 7 - How To Record Your Timeshare Deed

Send the notarized original to the county clerk's office with recording and tax fees. The original will be sent back to the new owner once the document has been recorded with county clerks office. Make sure to make copies of documents before sending to the recorders office, they will only send the original back out.

Step 8 - Get Your Timeshare Deed Sold

The new owner will send a copy of the recorded deed to the company/resort or management company along with a letter listing details of the transaction which includes new owner contact information. The new owner may need to pay a transfer fee along with the ne deed.
