The decision sustained the initial determination by the Department of Labor that the employee was entitled to unemployment insurance benefits. Specifically, the decision set forth the following: DECISION: The initial determinations, holding that Aristotle’s Alexander LLC was liable for contributions based on remuneration paid to the claimant and all other persons similarly situated beginning with the second quarter of 2010 are sustained. The employer’s objection contending the claimant was an independent contractor and not an employee is overruled.
