Employers Facing an Increasingly High Risk of Liability Lawsuits

Employment related lawsuits are on the rise, according to statistics that show an increase in lawsuits brought against companies by employees.

KATY, Texas - Oct. 12, 2013 - PRLog -- And it appears that in many cases, the employees are winning their cases. In many cases, the courts decide that the employee is right.

“According to the Department of Labor, employees and other plaintiffs won 41% of all jury trials and 26% of all non-jury trials in 1999,” states an article by Insure Cast.com.

“The average verdict in EPL cases now exceeds $450,000, and employment issues now make up 30% of all civil litigation in the U.S. Court cases of discrimination in the workplace and age discrimination court cases are on the rise,” according to Insure Cast.com

Employment practices liability insurance (EPLI) is a relatively new type of coverage that protects employees and companies against allegations that are made by employees. This liability insurance provides some protection against lawsuits related to discrimination, wrongful termination, and sexual harassment.

“ELPI covers a company in case of a lawsuit brought on by an employee, former employee, family of an employee, or even a potential employee,” explains Texas Outdoor Insurance. “In one sense, EPLI helps to connect workers’ compensation and general liability insurance. It serves to fill in the gaps left between the two policies. EPLI and workers comp are usually part of the same policy.”

This insurance is becoming increasingly necessary as employment related lawsuits continue to rise.

“Companies are finding that they are vulnerable from the pre-hiring process through the exit interview, even if the employee was never hired, or only at the company a matter of days,” states Insure Cast.com.

Experts recommend that companies with employees take out a comprehensive EPLI policy, that provides liability coverage for the company and their employees.

“In case of an employee lawsuit, EPLI coverage can pay for your defense expenses, as well as judgments and settlement costs -even if your company doesn’t win,” writes Texas Energy Insurance. “This extensive coverage makes EPLI an especially invaluable insurance coverage to have.”
