Kalka & Baer LLC Files Complaint Seeking Over $100K in Motorcycle Accident Case

ATLANTA - Oct. 8, 2013 - PRLog -- Atlanta, Georgia – On August 23, 2013, Attorney Anthony Kalka of Kalka & Baer, LLC filed a complaint, Transaction ID: 53871200 with the State Court of Fulton County in Georgia on behalf of a client who was seriously injured in a motorcycle accident that occurred in the spring of 2013.

On May 08, 2013, the plaintiff was driving his motorcycle north on Kings Rd when the defendant was driving a 2011 Toyota Land Cruiser north on Kings Rd. The defendant made an improper U-Turn in front of the plaintiff’s motorcycle, thereby causing a collision with the plaintiff. As a result of the collision, the plaintiff suffered serious and debilitating injuries including: a fractured hip, injuries to his left knee, and the groin region, which have resulted in sexual dysfunction.

According to the complaint, the defendant’s negligence includes, but is not limited to: U-Turn Prohibited (O.C.G.A. § 40-6-121), negligently traveling at an excessive speed under the circumstances, negligently failing to maintain his vehicle under proper control, negligently failing to keep a proper lookout, negligently failing to use or sound a signal warning, negligently failing to make a proper application of the brakes and other acts of negligence that may be proven at trial.

As a result of the defendant’s negligence, the plaintiff has and will continue to incur reasonable, necessary and continuing medical expenses which are likely to exceed $100,000, and will continue to incur expenses in the future in an amount that will be proven at trial. As a result of the defendant’s  negligence, the plaintiff has incurred and will incur lost wages, he has suffered physical pain, mental and psychological suffering, loss of enjoyment of life, inconvenience, and other injuries.

The plaintiff’s attorney, Anthony Kalka argues that the defendant is liable to the plaintiff in an amount to be determined by the “enlightened conscious” of the trier of fact for the plaintiff’s past and future pain, as well as his suffering, loss of enjoyment of life, and suffering caused by the collision.

In the complaint, it says that the plaintiff prays for relief against all defendants for personal injuries; mental anguish; disability; loss of the capacity for the enjoyment of life; incidental expenses; lost wages; permanent injuries; attorney’s fees and cost of litigation; past, present and future medical expenses.
