LEGISLATURE CANDIDATE JACOBS CALLS FOR ACTION FROM THE SUFFOLK SUPREME COURT LEADERSHIP

Smithtown, NY (July 18, 2013) Gary Jacobs, Candidate for Suffolk Legislature, calls for action by the leadership of Suffolk County Supreme Court.

For years there have been complaints about Supreme Court Judge Marion T. McNulty. There have been numerous allegations of Judge McNulty being disrespectful to both attorneys and litigants and condescending in court, but most importantly being biased in divorce proceedings and having a total lack of regard for children maintaining meaningful contact with both of their parents during and after a divorce.

Jacobs, a former litigant before Judge McNulty vowed to do whatever he could to make sure McNulty didn’t serve out her full term, in order to protect subsequent litigants. Court transcripts show McNulty telling Jacobs “I will be long gone before you get anywhere in politics”. It appears McNulty may have misjudged Jacobs’ resolve.

Jacobs is concerned that Judge McNulty’s recent announcement of her retiring five years before the end of her term (Newsday June 26, 2013) is an attempt by the Suffolk County Supreme Court to down play the reasons behind her departure. Jacobs is demanding that the circumstances related to Judge McNulty’s resignation be made public, including the details of any lawsuits alleging bias and inappropriate conduct by Judge McNulty.

This is not the first time Judge McNulty has had charges brought against her. On March 16, 2007, Judge McNulty was admonished for using her position as a Judge to solicit donations for a group she was involved in, Decision Women in Commerce and Professionals while sitting in her chambers.(http://www.scjc.state.ny.us/Determinations/M/McNulty.Marion.T.2007.03.16.DET.pdf). As is the case now, court leadership swept this under the rug, with no more than a slap on the wrist.

Jacobs states that since Judge McNulty has stated her intention to leave she, should be asked to step down immediately, not at some future date. “How can the Suffolk County Supreme Court allow Judge McNulty to serve on the bench one more day? Rule on one more case, with the cloud of bias and impropriety hanging over her? We cannot and should not allow this to go on”, says Jacobs. “Judge McNulty is not ruling on parking tickets, she is making decisions that will impact families for the rest of their lives.”
