Follow on Google News | Attorney David D. Diamond Fights a “Rush to Judgment” in Molestation CaseDavid D. Diamond, Los Angeles criminal attorney, fights back with the facts for an LAPD police officer facing accusations of molestation.
On May 18 of this year, an LAPD officer, Miguel Angel Schiappapietra, Jr., was charged with molestation. The allegations went public, and Mr. Diamond took action to protect his client in an email sent to reporters that were covering the story. The email read, “Officer Schiappapietra has no record of criminal wrongdoing nor any history of allegations of inappropriate contact with minors. With wild allegations already having gone public, let me be clear: there are no claims of penetration, oral copulation or molestation in any way, shape or form. Once the facts come out, it will be clear that everyone rushed to judgment.” Any person who is accused of a crime involving children can face an uphill battle when the press releases information, stories, hearsay or rumors, particularly when exaggerated, or not based upon fact. Mr. Diamond has taken action to protect his client from these rumors and the quest for a sensational story by providing reporters the facts of the case as it stands at this point. His client has entered a plea of “not guilty.” Attorney David D. Diamond, a founding partner at Diamond & Associates, is a State Bar Certified Criminal Law Specialist, and serves an Associate Adjunct Professor of Law at Southwestern School of Law, in the Trial Advocacy Honors Program, and as an Associate Professor of Criminal Law. He also served in the L.A. District Attorney’s Office earlier in his career, and is recognized as a one of Los Angeles’ top advocates for the rights of the criminally accused. As a defense attorney, litigator and educator for other lawyers, Mr. Diamond is passionate about the subject, as is shown in his recent email to reporters covering the Schiappapietra case. He has made it clear in his efforts to protect his client that the least that that could be offered our law enforcement officers, or any others accused of a crime, is that they could have their day in court, and that judgment is no passed by reporters or others prior to the facts in the case being presented in court.
