Drinking Establishment Faces Wrongful Death Lawsuit

STOCKTON, Calif. - May 30, 2013 - PRLog -- Wilson Harvey Browndorf LLP, a Southern California commercial litigation law firm announced the filing of a wrongful death and premises liability lawsuit against a Northern California bar and the property owner, claiming inadequate security pertaining to gang violence on the premises, leaving an innocent Northern California man dead and two injured.

The TX nightclub was the scene of a gang related shooting on June 8th, 2012 resulting in the death of a Northern California man, and injuries suffered by his friend and brother

According to the California Supreme Court case of Delgado v. Trax Bar & Grill, 36 Cal. 4th 224 (2005), a bar proprietor stands in a special relationship with its patrons and invitees, and hence owes a duty to undertake “reasonable steps to secure common areas against criminal acts of third parties that are likely to occur in the absence of such precautionary measures.”

Gabriel Sanchez, associate attorney at Wilson Harvey Browndorf LLP, works on the legal team supervised by Marc Lazo, Managing Partner of Litigation, as the incident occurred in his hometown, and resulted in the death of a man he called his friend. “Our lawsuit has added the San Joaquin Sheriff’s Department.  Deputies on the scene confined the victim’s brother in the back of a patrol vehicle for over two hours without reasonable suspicion or probable cause,” said Sanchez. The deceased body was in near proximity and in plain view to the patrol vehicle.
