March 19, 2013 - PRLog -- Legal document preparers serve consumers by offering a low cost alternative for handling routine legal matters. More and more consumers are realizing that if they are not embroiled in a dispute, if there is no argument at hand – then hiring an attorney may not be necessary. And while some consumers are perfectly comfortable preparing their documents with no help at all; others choose to hire a document preparer to make sure their documents have the professional touch. Either way, they choose to go pro se. One of the primary barriers for document preparers to be able to continue to assist pro se litigants is unfounded accusations of engaging in the unauthorized practice of law.

Florida Association of Legal Document Preparers, FALDP; and The Nationwide Alliance of Legal Document Preparers, NALDP; were formed to assist pro se litigants in accessing the legal system. One way we further this goal is through education.

To go pro se, to go to court without an attorney can be a frightening experience. Even for those who are confident that their argument is persuasive, the mystery of procedure can be overwhelming. Successful pro se litigants immerse themselves in research and do their best to understand the arcane language and convoluted reasoning of the U.S. legal system.

For pro se litigants, legal document preparers are a godsend. Legal document preparers are prohibited from offering legal advice or representing anyone in court, but the professional preparation of legal documents levels the playing field. Studies show that pro se litigants who file well prepared documents command more respect. Whether the documents were prepared by the litigant, or by a legal document preparer is irrelevant.

One of the biggest challenges that legal document preparers face is how to avoid getting trapped in the murky netherworld of unauthorized practice of law (UPL). Although document preparers go to great lengths to avoid even the appearance of engaging in the unauthorized practice of law, the lack of clarity in the UPL rules and the extreme prohibitions in free speech make it difficult for some to maintain a thriving business.

On Saturday, March 23 at 11:00 a.m. EST, the Florida Association of Legal Document Preparers, FALDP; and the Nationwide Alliance of Legal Document Preparers, are co-hosting a Webinar - the First UPL Summit of 2013. This is a free Members Only webinar, and is restricted to Members of FALDP; Members of NALDP; and certain approved invited guests.
