Identify Thieves: What Can Be Done To Clear Your Name After They Make You Their Victim?

Feb. 24, 2013 - PRLog -- On March 12, 2012, Trust Mediation www.trustmediation1.com received a call from a concerned potential client.  The client needed help because her identity had been stolen by an identity thief.  The thief used her name to create false documents, make outlandish purchases and eventually commit crimes with lasting negative effects on the victim's credit report and future reputation.

The local police investigated the case and narrowed down the whereabouts of the innocent victim.  The victim was humiliated when the police picked her up at her place of employment and arrested on the charges of theft by deception and conspiracy to commit theft by deception on an outstanding warrant.  (The real criminal had not shown up for court because she didn't have to, she was operating under someone else's identity)  The innocent victim, not having a strong command of the English language, and knowing she was an undocumented worker, did not object to the charges.  The innocent victim was branded a criminal with several charges levied against her for a crime she did not commit.

One day, the victim hired a lawyer to investigate these charges.  After some digging around the identity thief was found and summoned to court.  The judge and prosecutor apologized to the victim for having caused her such anguish.  However, the victim's lawyer did nothing to clean the victim's record, after having the charges imposed on the identity thief thinking this would be taken care of by the court's administrative staff.  Years later, the victim and the identity thief both had identical criminal records.  The victim sought help from several attorneys, none of which knew what to do in this case.

To my surprise, many lawyers didn't know what could be done in this case.  It was quite confusing to say the least.  Trust Mediation started the criminal record expungement process.  When the prosecutor received the expungement he naturally objected, claiming "this person had a criminal record that could not be expunged because there were more charges that needed to be included in the expungement request."  In actuality, what happened was that the State Police had two identical records with the same criminal charges for two people with the same name, and this had never been exposed as an incorrect record.  Even the State Police could not tell who the real McCoy was.
