Mother’s Felony Assault with a Deadly Weapon Charge is Dismissed

A Nevada woman was charged with felony assault with deadly weapon and misdemeanor domestic violence after her husband claimed that she had pulled a gun on him and threatened him.

Jan. 11, 2013 - PRLog -- A woman and her husband were having marital issues as many married couples do. The wife and mother was aware of the fact that her husband wanted a divorce and was seeking ammunition against her in an effort to gain custody of their children, another common occurrence amongst divorcing couples.

One day her husband decided to call the police, he alleged that his wife had pulled a gun out on him, threatened to injure him, and hit him. He allegedly called the police a few days after the incident in question took place. The husband told the police that he had witnesses – their own children.

The responding officers took statements that evening and the state wound up charging the wife and mother with felony assault with a deadly weapon, which carries up to six years in prison; they also charged her with misdemeanor domestic violence.

Beside the criminal penalties, the mother was well aware of the ramifications under Nevada law in family court and what would happen to the custody of her children. The woman hired Las Vegas criminal defense attorney Chip Siegel to defend her against the criminal charges. Through an in-depth investigation into the court orders and child protective custody investigation, Chip convinced the prosecutor to immediately dismiss the felony charge against his client.

Afterward, the state agreed to have a preliminary hearing where they would reevaluate the case. Ultimately, the state dismissed the case and the mother was returned to her children.
