PC has filed a Complaint in the United States District Court for the Eastern District of New York against The City of NY.

The Complaint, which also names the yet to be identified NYPD officer who arrested him, alleges various causes of action which include a claim for False Arrest, Unlawful Stop & Seizure and Fabrication of Evidence. Unfortunately, the allegations contained in the instant complaint are not novel. In fact, as recently reported in The New York Times on October 4, 2012, a federal judge in Manhattan ruled that purported rules against loitering in public housing complexes are unconstitutionally vague, and give the police too much discretion about who to arrest. The Honorable Shira A. Scheindlin also ruled that the police cannot arrest someone for trespassing “if the only facts known to the police are that the person says she does not live in the building and refuses to say more about her license or privilege to be there.” Plaintiff’s Legal Representation: Michael J.
