Judge Throws Out Urine Test in DWI Case
In a recent Dakota County DWI case, the defendant’s counsel called into question the accuracy and reliability of the testing methods used to calculate their client’s blood alcohol concentration.
The firm views every DWI case they get differently, and in their eyes they see each case they take on as a new opportunity to win. In this particular Dakota County case, the firm argued two theories over why the test results were unreliable. Initially the firm argued that the Minnesota Bureau of Criminal Apprehension’
Ramsay Law Firm is one of the pioneers in the field of DWI, and they are using this “uncertainty of measurement”
The firm also argued that the test results in this particular case were unreliable due to the fact that the exact machine that was used to test the sample was calibrated in such a manner as to falsely inflate the test results. Therefore, instead of taking the test results for face value, the firm closely examined each step in the process that was used to analyze their client’s sample, and they found this calibration error. This particular error in calibrating the machine could affect the entire outcome of their client’s case which could mean the difference between a not guilty verdict and a conviction.
After half a day of expert testimony and an in-depth argument given by the Ramsay Law Firm, they still refused to back down from the fight, especially one where they knew they had a valid point. After presenting a strong and compelling case, at the end of the day the judge ultimately agreed with the firm’s arguments and threw out the test. The firm was also successful at highlighting the unreliability of the state’s position on DWI tests, and refuted the state’s claims that their testing methods are infallible.
This successful case win is just one example of the firm’s many successes over the years, and it clearly illustrates just two of the legal defenses that can be used in a DWI case. The attorneys at the Ramsay Law Firm have been representing individuals against DWI charges in Minneapolis and St. Paul for over 15 years. Over which time the firm has tried dozens of jury trials and handled numerous appeals. The attorneys at the firm are well-versed in the science behind the Gas Chromatograph, the device used to determine blood and alcohol concentration. They are also certified as trained operators in the Intoxylizer 5000, which enables them to question every aspect of a DWI case.
The firm’s founder, Charles Ramsay is a member of the prestigious Minnesota Society for Criminal Justice (MSCJ), which is limited to the top 50 attorneys in Minnesota. He was also included in the selection of Minnesota’s Super Lawyers®, which is limited to not more than 5 percent of attorneys in the state. Charles Ramsay was among the top 40 criminal defense lawyers in Minnesota for the last two years in a row and was selected as one of the Attorneys of the Year in 2000 by Minnesota Lawyer.
