Attorney Mark Freedman Quoted In Detroit News Article Regarding Car Crash

Brooks Patterson. In the accident involving Mr. Patterson, all parties involved failed to buckle up, according to the article, which was titled “Patterson, drivers in crash weren’t wearing seat belts, police say.” The Aug. 14 news story, outlining the details of the accident as reported by the Auburn Hills police, alleges that a Volkswagen Passat pulled in front of Patterson’s Chrysler 300, which was being driven by his long time driver.  The ensuing collision resulted in serious injuries of the individuals involved, including Patterson.  According to local police, it appeared the Volkswagen driver failed to yield the right of way while making a left-hand turn at the intersection. Since the injuries that resulted from the crash were so serious, the case is expected to be presented to the Oakland County Prosecutor’s Office once the investigation is complete.  Subsequent charges were, in fact, filed against the driver of the Volkswagen Passat.

Mr. Freedman stated in the article that violation of the safety belt law does not currently lead to points being placed on an offender’s driving record, but generally does result in a fine of less than $100. He was also quoted as saying that the failure to wear a seat belt becomes an issue in civil cases where an injured party seeks monetary damages against the at fault party and the case proceeds to court. When that occurs, the damages a responsible or at fault party is required to pay an injured person must be reduced by 5 percent due to the failure of the injured person wear a seat belt in contravention of the law.
