Sept. 25, 2012 - PRLog -- Los Angeles, CA - The Bankruptcy Law Firm, PC, recently obtained a summary judgment of nondischargeability in an adversary proceeding, in favor of a Bankruptcy Law Firm, PC creditor client.  The summary judgment, in favor of Law Firm's creditor client, held a California Superior Court judgment to be nondischargeable (i.e., not discharged by the bankruptcy discharge that the judgment debtor, who had filed bankruptcy, received in that debtor's bankruptcy case), based on the collateral estoppel effect of the Superior Court fraud judgment.

Law Firm had moved for and obtained relief from the bankruptcy automatic stay, to allow the creditor client to proceed to judgment in California Superior Court.  The creditor client obtained a Judgment in state court, against the debtor, for fraud. The creditor client had filed the client’s Superior Court suit against the defendant, before the defendant in that suit filed bankruptcy.  However, the debtor filed bankruptcy before the creditor was able to get judgment entered, in Superior Court, against the debtor.

When representing creditor clients in adversary proceedings, Law Firm is experienced in bringing motions for summary judgment of nondischargeability, based on the creditor having obtained a final superior court judgment against the debtor, for fraud, or for a willful and malicious act by debtor, or for some other tort that is nondischargeable in bankruptcy, pursuant to 11 USC §523(a)(1) et seq.
