California Journalist Petitions the U.S. Supreme Court for Restitution to Consumers Harmed by Fraud

On September 24, 2012, the U.S. Supreme Court will consider a CA journalist's petition for relief from injunctions that prevented her from warning consumers and tenants about fraud targeting them. She seeks restitution for those deprived of warning.
 
Sept. 17, 2012 - PRLog -- On September 24, 2012, the U.S. Supreme Court will consider a California journalist's petition for relief from injunctions unlawfully issued against her in 2009 by Orange County Superior Court Judge Franz E. Miller.   These permanent injunctions were issued on behalf of the State Bar of California, the California Dept. of Real Estate, and Landlord/REIT, UDR, Inc.

These unconstitutional "prior restraints" of speech sought to:

a.     prevent her from warning consumers in foreclosure about loan modification fraud targeting them;

b.     prevent her from informing California UDR tenants about the illegal clauses contained in its residential lease; and

c.     inhibit  her ability to advance unified petitions of redress on their behalf.  

As the result of these injunctions, hundreds of thousands of consumers and tenants were deprived of warnings about fraud and fell victim to scams they could have avoided.  

The journalist, Newport Beach, California native, Erin Baldwin, seeks restitution for consumers and tenants as well as the reinstatement of her First Amendment rights.
