Dec. 20, 2011 - PRLog -- Prior to the HMLAP, homeowners had to hold out for a sale to a buyer who could bring cash or new financing to closing, or was able to formally assume the existing mortgage in those few cases where the home has an assumable loan.  A company spokesperson stated that the Home Mortgage Loan Assignment Program (HMLAP) is available to all homeowners, regardless of the lender or type of mortgage loan in place.

USA Home Buyer is working with homeowners nationwide using the new program, and explained how the program works:  USA Home Buyer submits a purchase offer to buy the seller’s home.  The offer is often at full asking price, even if the seller has little or no equity, or is underwater (owes more on the home than it is worth).  If the purchase offer is accepted, a closing is scheduled, where both parties sign the HMLAP documents, which transfer title (ownership) of the home, and assigns future mortgage payments on the existing mortgage loan to the Buyer.

Although the seller’s name does remain on the loan for a short period of time after closing, sellers can feel safe knowing the payments are being made, since the special HMLAP documents require payments to be made directly to a mortgage servicing company, to be forwarded to the mortgage company. The HMLAP forms also include legal documents which allow the seller to take the property back in the unlikely event there were ever a default in payments.  The Home Mortgage Loan Assignment Program also allows the buyer and seller to agree on the length of time until a full payoff of the loan is required (typically 1 to 5 years).
