KNAUF Chinese Drywall Settlement-NOW Peel the ONION-Questions, Details, Guidelines to COLLECT ???
Recently announced "GLOBAL" Knauf Tainted Corrosive Chinese Drywall Settlement, as with ALL settlements, presents affected parties with options that sound very promising, but will require careful review of the details, before celebrations can start !
Dec. 18, 2011 - PRLog -- Global Knauf Settlement covering Tainted Corrosive Drywall (TCDW or CDW), manufactured in CHINA will be a major step towards resolution for thousands of affected or should I say INFECTED victims or consumers with structures plagued by the off-gassing or out-gassing, emitted by KNAUF Brand "Chinese" drywall, as well as numerous other "Chinese" drywall brands.
Based on my CDW / TCDW field experience not only diagnosing INFECTED structures, but also demoing, abating, treating, re-constructing infected structures, reviewing EPO's, answering Lawyer / Attorney questions, presenting TREC certified and approved CDW / TCDW Training, and a leading expert on the subject ...
Several major questions concerning this specific proposed settlement and lack of numerous clear and specific details come to mind ...
1) How and Who is qualified as a claimant ?
2) Documents required to submit a claim ?
3) Documentation required to collect on a claim ?
4) Documentation required to validate "KNAUF" Brand drywall installed in the structure ?
5) Specific "GLOBAL" certified and validated corrective Protocol ?
6) Who approves or rejects claims, documents, and unknown guidelines ?
7) How are structures with "multiple" CDW / TCDW Brands handled ?
8) How many Knauf Brand CDW / TCDW boards required to collect ?
9) Will settlement amounts be based on actual number of confirmed KNAUF Brand boards ?
Just a few SIMPLE QUESTIONS that require answers and details ...
I would strongly suggest victims or consumers request, demand, require, and force ...
FULL and DETAILED DISCLOSURE of the above mentioned issues by Judge Fallon and the PSC (Plaintiffs Steering Committee) for review, questions, and clarification BEFORE final Judge Fallon APPROVAL.
Please remember one key word ...
PROPOSED ... concerning this settlement, and also the unknown time-frame before a "FINAL" Global Knauf Settlement is actually APPROVED, and the specifics and guidelines required to actually COLLECT.
Also remember, Judge Fallon and the PSC specifically, clearly, and with very detailed guidelines have determined HOW and WHEN Attorneys / Lawyers will be paid and more importantly ... HOW MUCH !!!
At this time, I think it is only fair, just, legal, and mandatory ...
FULL DISCLOSURE of ALL the facts, details, guidelines, time-frame, and actual settlement amounts, each Homeowner, Victim, or Consumer can expect or hope to collect.
Announcements all sound great, until you start to "PEEL THE ONION" and cry over WHO, WHAT, WHEN, and HOW you actually become eligible to collect and when is the CHECK actually issued, mailed, received, and CASHED !!!
