On Wednesday night a federal judge enacted this block after the ACLU went to court saying this test was unconstitutional.
By: OxyContinOnline.net Reports said there were six students at Linn State Technical College that the ACLU filed a suit on behalf. These students wanted an injunction to end what was called “suspicionless” The program was implemented this fall by Linn State. The college felt it was necessary to do this to ensure safety at their school. Linn State has courses that include aircraft maintenance, heavy engine repair and nuclear technology, these come with dangerous tasks. The two year college has 1200 students, they have locations in the mid-Missouri towns of Linn, Jefferson City and Mexico. The testing program wants all first-year students to take this test and also all returning students that are seeking a degree or academic certificate. New students were told about the testing program in the spring and during fall orientation. The lawsuit states that Linn State has never had a history with drug problems. The college cannot demonstrate a legitimate special need for drug testing its students. It claims the students have individual privacy expectations against the state. Education and drug prevention is one of the very first and important steps for drug abuse.
