RPost Sues Telarix for Infringing Three Patents

Aug. 11, 2011 - PRLog -- Los Angeles, CA --- August 11, 2011 --- RPost, the inventor of Registered Email® services and a pioneer of electronic signature services announced today that it has brought suit against Telarix for infringing three RPost patents in Telarix’s handling of 10 million monthly telecommunications transactions. RPost has asked the U.S. Federal Court to issue an injunction against Telarix to prevent further damages.

RPost’s flagship Electronic Signature and Registered Email® services provide senders legally valid, court admissible evidence of email content, timestamp and delivery, with options to irrefutably record the recipient’s consent to attached contracts with legal electronic signatures. RPost, founded in 2000, is one of the pioneers in the telecommunications rate notice delivery and e-signature service marketplace with its Registered Email legal delivery proof and electronic signature services.

Within the competitive international telecommunications marketplace, it is essential that operators optimize rates, pricing margins, and invoice collections as many operators move to electronic platforms to manage these processes. Missing or disputed time-critical rate pricing, costing, and invoice notices have direct consequence to telecommunications operators’ cash and profit margins. With many having recently converted these legal notices to email from fax and paper, they are now realizing standard email systems leave little protection in a dispute around what was sent and received by whom and precisely when – the basis for most disputes.  For several years, the telecommunications marketplace has relied upon RPost’s RateLock™ service, operated on RPost’s Registered Email technology platform, for legal and court-admissible records of delivery, message and attachment content, and official uniform time associated with sending and receipt of such consequential notices.

“Telarix customers clearly see value in RPost technology for proof of delivery, content and time of telecommunications notices. We offered Telarix the opportunity to tie its technology platform to RPost’s Registered Email system for legally valid proof of delivery of time-critical customer notices,” reports RPost CEO Zafar Khan. “They refused, and rather, willfully used RPost’s published patents as a technology guide to build their own system. Telarix managers have ignored RPost’s strong patent protection in an act of technical plagiarism.”

RPost has filed a suit claiming essential elements of Telarix iXLink and iXTools offerings infringe three of RPost’s United States patents – patent numbers 6,182,219; 6,571,334; and 7,966,372. Telarix is knowingly taking property at will for what appears to be its own financial gain.

“We have patents issued worldwide,” Khan says. “We intend to defend all of our intellectual property, everywhere.”

The lawsuit is part of a successful RPost campaign to enforce its patent rights. RPost’s 35 patents granted worldwide have priority over technology dating back to 1995. These patents broadly cover the technologies of verifiable proof for email delivery, recording recipient consent and signatures associated with received messages and documents, and value-added outbound email processing.  RPost patents have been granted in Australia, Austria, Belgium, Canada, China, Denmark, France, Germany, India, Ireland, Italy, Korea, Luxembourg, Mexico, Netherlands, Portugal, Spain, Sweden, Switzerland, United Kingdom, and the United States; with numerous additional patents pending.
