Your Debt Consultant will explain the positives and negatives of the debt resolution and or bankruptcy process. If your consultant has determined that you have met the submission criteria, they will send out an enrollment package to be completed by you. You’ll need to complete all your creditors’ information, including account numbers and current balances before sending your contract back. Once your consultant has received your completed enrollment package, your consultant will submit your file to Underwriting for initial review.

A paralegal from the Law Firm will attempt to call you within one hour of receiving your submission for quality control purposes. Within 24 to 48 hours you’ll schedule a face-to-face meeting to meet your paralegal.
Once the process begins, you’ll begin to fund your specialty account and our negotiators begin to work on settling each account one by one. When enough money is in your account for a resolution, your negotiator will work on a resolution with that creditor. The negotiators are trained in knowing which accounts to settle first. Each case is different. Once an account is settled, your balance in your account will decrease nearing zero. This procedure is continued until all accounts are settled.

What debt can I get rid of and which debts can’t I get rid of?
The U.S. Legal Services Group has determined the following Acceptable Debts that can be settled.
Unsecured Credit Cards, Unsecured Personal Loans, Unsecured Business Credit Cards, Medical Bills, Cell phone Bills in Collection, Jewelry Store Loans, Furniture Store Loans, Unsecured Lines of Credit, except Credit Unions, Visa or MasterCard Unsecured Credit Union Credit Cards, Auto Repossession, Gas Cards (shell, mobile, etc), Utility Bills, only if owned by third party collection agency, Cash Call Loans, Retail Store Credit Cards — Target National Bank, only if it’s under $2000, Target National Bank, if over $2000 disclaimer is required
Unacceptable Debts include Secured Loan (Mortgage, Equity loan, etc.), Student Loan, Auto Loan, Credit Union Loans, Credit Union Lines of Credit, IRS & State Tax, Time Shares,, Judgments and Stipulated Judgment Agreements, Accounts with a Summons, Accounts with prior Arbitration agreements, Military Accounts, Utility Bills, in-house, Payday loans, Cell Phone Bills (Not yet in collection)
The Fair Debt Collection Practices Act (FDCPA) places restrictions on what a creditor and collector can do in order to collect on a debt. Your legislation treats the two differently, although some states such as California have mirrored the FDCPA to apply equally to both creditors and collectors.
