Annulment of the town plan for Chiclana - what next?

With the announcement in the media on Friday 1 July that the Supreme Court has nullified the Chiclana town plan and another is to be drawn up by 2013, many peoples hopes of moving forward with the urbanisation situation in Chiclana have been dashed.

July 4, 2011 - PRLog -- With the announcement in the media on Friday 1 July that the Supreme Court has nullified the Chiclana town plan and another is to be drawn up by 2013, many people´s hopes of moving forward with the urbanisation situation in Chiclana have been dashed.  In the interim period the 1987 plan is to be used as a reference.
Lesley McEwan, MD of Cadizcasa Estate Agents said “It was a very surprising and disappointing piece of news.  We knew that there would likely be changes due to the change of political party at the last local election but a complete annulment by the Supreme Court was not what I personally expected.  We have worked closely with hundreds of Chiclana residents to help them identify problems with their homes and get their homes marketed honestly to potential buyers.   Without a definitive plan to work with this will be much more difficult over the next 18 months.  As an estate agent it is difficult for us to advise clients when we are not able to say what classification their property will have in 2 years’ time.  I think these events will bring more uncertainty and unrest to many people and may leave the door open for disreputable people in our industry to sell properties with problems to unsuspecting buyers while failing to give the full information or make them aware of the possible consequences.


I have never been convinced  and am less convinced after these events that urbanisation is a subject which should be controlled by local government which is led by politicians.   It seems to me that the urbanisation question needs to be placed in the hands of a body which is not affected by politics and I would call upon the Spanish Government to look at this matter and try to put in place a more stable means of handling the urbanisation question.  It is a subject which affects many thousands of people in Chiclana and on the Costa de la Luz who have been waiting years for a solution which still has not come and now is unlikely to come for at least another 18 months”.


When asked if this could herald the recommencement of demolitions, Lesley said “I do not think we can rule that out but we need some guidance from the Townhall on what stance they have been instructed to take by the Judiciary.  I certainly hope that will not be the case and things are left as they stand until we have a new plan which is passed as law”.


We will continue to do our best to assist people with our free property advice and valuations but the time has come for there to be a settlement of this issue and I hope that the forthcoming plan will be the last so we can move forward.  Chiclana is a wonderful place to live and attracts thousands of visitors every year but the cloud of urbanisation has hung heavy in the air for many years now and we need a definitive solution.  If we do not get this matter resolved we are at risk of damaging the property market irreparably”.
