The article examines the current U.S. immigration options for highly skilled workers, including the EB 1-1 visa, the EB 1-2 visa, and the National Interest Waiver.  The EB 1-1 Visa allows individuals with "extraordinary abilities" to enter the United States without a labor certification or a sponsoring employer.  An EB 1-2 Visa allows individuals who are "outstanding professors or researchers" to gain permanent residency without a labor certification.  The National Interest Waiver allows individuals to self-petition to become permanent residents.  The National Interest Waiver requires an applicant to demonstrate that his or her work in the United States will be in the "national interest."  The article emphasizes the continuing controversy surrounding the qualifying requirements for these visas. The article argues that the controversy has limited the number of highly-skilled workers who have entered the United States in the last 20 years.

The article also compares the U.S. immigration options for highly skilled workers to the options available in other highly-developed countries, such as Canada, the United Kingdom, India and China.

The article concludes by offering suggestions on how to improve the current U.S. immigration system for attracting the best and brightest immigrants.
