Bribery Act clarification lifts a shadow from London2012 corporate hospitality says PROSKE

The London 2012 Olympic Games will include a wide range of corporate hospitality programmes for sponsors, partners and other businesses looking to entertain current and potential customers and partners.

The Bribery Act will enter into force on July 1 and there were fears that its conditions could essentially have made corporate hospitality illegal.

Speaking ahead of SportAccord, which will be held in London next week, René Proske commented: “We are delighted to read the clarification by Justice Secretary Kenneth Clarke, which will be a huge relief to everyone involved in major sporting events including the London 2012 Olympic Games next year.

“PROSKE is an international company and we have encountered this sort of compliance before, particularly in central Europe. There have been too many grey areas and it makes our job a lot more difficult. Mr Clarke’s clarification this week will make life a lot easier for everyone planning corporate hospitality at London 2012.

Proske also thinks that company audits are vital to ensure that businesses stay within the conditions of the Bribery Act and do not fall foul of the new law.

He added: “What sort of corporate hospitality provision is ‘reasonable’? Clients will have to define ‘reasonable’ within their own organisation and ensure boundaries are adhered to. All corporate hospitality will have to fit into these criteria.

“The simplest way to ensure this will be to have any offerings independently audited – and this is common with big firms already. This will certainly have an impact on the more lavish corporate hospitality packages. PROSKE can do company auditing but we also assist them to put reasonable compliance together.

“There is such a difference between booking a seat and buffet in a marquee outside a stadium and offering champagne and caviar in a lounge around a 10-day overseas trip. A lot depends on company budgets – which relates to the size of their business. What would be lavish for a small business may be modest for a multi-national.”

Justice Secretary Kenneth Clarke was reported as saying: “Bribery is one of those things we all know when we see it. It is a cynical attempt to manipulate someone’s judgement by financial or similar means ... So under this law no one is going to try to stop businesses taking clients to Wimbledon, or a Grand Prix.”
