Knauf Pilot Repair + Expert Answers Questions = Facts and Truthful Information + Informed Consumers

Knauf Chinese Drywall Pilot Repair Program, obviously written by an educated and skilled construction attorney, provides general information with very little substance concerning specific details, savvy Consumers require to make an informed decision.

Dec. 8, 2010 - PRLog -- Knauf CDW Pilot Repair Program ... 151 Page Document ... after close review ... lacks numerous specific details required to label or infer the document as a Protocol or Guideline that can be followed, implemented, endorsed, or even recommended ... with-out significant answers concerning ... "Terms and Definitions" ... that are open to numerous legal interpretations and opinions.

What appears to be the "Scope of Work"  Exhibit D ... on pages 40 - 43 ... starts with the following terms ... "Remediation Work" ... "Mediation Process" ... "Demonstration Remediation Agreement" ... "remove on a cost effective basis all drywall, problem drywall-related odors, and contamination, including, but not limited to, corrosion, tarnishing, and pitting ("Contamination") ...

http://www.laed.uscourts.gov/Drywall/DemonstrationRemediationAgreement.pdf

To the untrained, construction professionals eye, and Consumers, the document appears to cover issues related to abatement, treatment, and re-construction ... but to the trained Construction Professional or savvy Consumer ... the lack of details and specifics ... creates another opportunity for the Consumer to be victimized ... again.

Example: Answer to one simple question ...

Is all sheet-rock or gypsum board removed 100% ???

Per Knauf document, page 40, Item #1, ALL drywall removed ... EXCEPT ...

A - Type "X" Fire Rated Board
B - Thicknesses other than 1/2 inch board
C - Moisture Resistant Drywall (Green Board)
D - Sag Resistant  Gypsum Board
E - Tile Backer Board

Sounded good ... until term "ALL" was qualified with EXCEPT ???

My firm has written several articles concerning questions, provided Construction Document Analysis Opinions, and specific answers Consumers need before signing or agreeing to abatement, treatment, and re-construction contracts or documents, ...

Answer a few of the following questions, after reading or reviewing the attached document ...

http://www.laed.uscourts.gov/Drywall/DemonstrationRemedia...

Pages 40 - 43, and then ask yourself ...

What do I really know about specifics of the work covered under this agreement, and do I need a Professional CDW Advocate to explain the pros and cons of protocol and process I'm agreeing too ???

Who determines Abatement Guidelines ???
Who determines Demo Guidelines ???
Is all sheet-rock removed ???
Is all HVAC duct-work and equipment removed / replaced with new components ???
What Treatment Systems are available or on the market and plan to be used ???
What Treatment Systems actually work and Who can apply ???
What Treatment Methods are required and Who specifies them ???
What Treatment Products will be applied, and Who certifies application ???
What Testing Guidelines will be followed and documented ???
Who certifies and performs Testing Guidelines ???
What Post Treatment Testing Guidelines will be followed and documented ???
Who certifies and performs Post Treatment Testing Methods ???
When does or can Re-Construction start ???
What needs to be treated ???
Who determines what needs to be treated ???
What is the treatment material or product ???
Is the treatment product toxic ???
Who is qualified to perform the treatment application ???
How long does the treatment take ???
How do you confirm the treatment was successful ???
Who guarantees the treatment ???
What type guarantee comes with the treatment application ???
What licenses are required for the treatment ???
Is the treatment product registered for use in your state ???
What is the products approved or registered application for ???
How long does the treatment take to be effective ???
How many applications has the company performed ???
Can we talk with your last (20) twenty treatment customers ???
What insurance does the Treatment Company carry ???
What evidence will I need, to support future litigation concerning Health issues ???
How is my lawyer or other lawyers compensated or paid ???
Why has my lawyer recommend this process or agreement ???

Starting to understand the questions and details I'm discussing, Consumers need answers and specific guidance, prior to starting or signing an agreement or contract.

Consumers need to do their homework and understand ... abatement and treatment applications ... are not all created equal, do not always work, vary in cost, vary in application methods, vary in application materials, not always guaranteed, not always Eco-Friendly, not always applied for their approved application or use, not always registered for use in your state, and simply stated ... NOT ... always in the Consumers best interest  ... PERIOD !!!

Closer examination of this document (attached above), requires a Construction Consultant or Construction Expert to fully understand the real "Scope of Work" covered by this document.
