Follow on Google News | Foreclosure Meltdown Prompting Regional Eviction Freezes.Well, apparently not all public officials are hesitating to take matters into their own hands. Thomas Dart, Cook County’s sheriff, has declared Chicago and its surrounding areas, “a foreclosure free zone.”
By: Barbara Israel Having singled out GMAC, Bank of America and JPMorgan Chase to date, Dart is so disturbed by public allegations regarding the bank’s callous and potentially fraudulent foreclosure practices, that he has elected to postpone executing approximately 1,000 eviction requests. As reported at: http://savemyhousenow.net, that number is expected to continue growing. Per a press release distributed by his office, Dart stated, "I can't possibly be expected to evict people from their homes when the banks themselves can't say for sure everything was done properly. I need some kind of assurance that we aren't evicting families based on fraudulent behavior by the banks. Until that happens, I can't in good conscience keep carrying out evictions involving these banks." Dart’s focus is not limited to the big 3. He’s stated that he’s ready to add other banks alleged to be engaged in makeshift foreclosure processing. He’s even upping the ante by demanding that banks legal representatives sign documents showing that foreclosures truly meet the legal standard, before he will agree to move forward. Other states, inspired by Sheriff Dart’s actions, are also taking action. New York’s chief judge, is demanding that banks attorneys there also submit signed affidavits regarding the accuracy of submitted foreclosure documents. In Massachusetts, a 2009 state land court ruling has forced banks to resubmit hundreds, if not thousands of foreclosure documents. This has given some homeowners the opportunity to repurchase their homes at their current market value.
