Real Estate Agents in Spain.
In Spain, at present there is no law that specifically regulates the real estate profession, which includes not only estate agents, but developers, builders, lawyers, profiteers. This was not always the case, as many years ago in Spain there was a law that allowed only suitably qualified people to sell Spanish property. Requirements to enter the profession included having a university degree along with a diploma granted only after the successful completion of the appropriate real estate course and membership of the professional association API. The profession was, just that Professional, architects and lawyers, all with the required diplomas formed part of the profession. The law made it illegal for people who did not have a real estate agents title and did not belong to the professional association to sell Spanish property.

As Spain became more integrated into the European Union and more foreigners moved into Spain, the laws governing the real estate profession and the professional qualifications were either abolished or reformed, leading to the situation that exists  today where practically anyone can be an ‘estate agent’, no educational qualifications required, no experience required, no training required.

Spain now has the exact reverse of the norm expected in many civilised countries in respect of the real estate profession – total deregulation- and although there are many honest, reputable and responsible real estate agents, there too exists a breed of unqualified, unscrupulous, unprofessional and unregulated estate agents, property intermediaries and developers. Such an unregulated ‘free for all’ leads to little or no protection to the public at large when buying a Spanish property through such an intermediary.

» No urbanizable – land that is non constructible.
Once it is confirmed that you are purchasing the type of land that you require you will need to submit a dossier to the relevant authorities for your project. This should be dealt with by a competent authority as planning issues in Spain are complex and can easily be misinterpreted.
To protect yourself NEVER sign a contract to purchase a property whether in a rural or urban environment until you have had the land title checked out.
