Derivatives Conference to Dissect New Framework for Derivatives Regulation on July 22nd in New York

June 15, 2010 - PRLog -- The market for credit default swaps (CDS) has grown exponentially within the last decade. According to the International Swaps and Derivatives Association’s historical survey of the size of the CDS market, the marketplace grew from a notional value of around $630 billion in the second half of 2001 to $36 trillion by the end of last year, equivalent to roughly two and a half times the amount of goods and services sold in the American economy annually. Now that financial reform is being discussed in Congress, proposed regulations will focus on derivatives dealers, trading and central clearing in order to reduce risk in the credit default swap market.

The New York Times reports: "Much of the action centers on a provision sponsored by Senator Blanche Lincoln, Democrat of Arkansas, to effectively bar banks from trading derivatives, the complex instruments that have been implicated in the financial system chaos that followed the near collapse of the mortgage market in 2008. On Monday, Mrs. Lincoln offered to ease some of the toughest elements of her provision, but not enough to assuage Wall Street’s concerns."

Under Senator Lincoln's latest proposal, which will ultimately be reviewed at Derivatives Leaders Forum 2010, banks would have two years to spin off their derivatives arms. "A bank holding company could still maintain a derivatives operation — but as a separate affiliate with its own capital, not as part of a commercial bank. In addition, companies that are not major dealers in derivatives would be exempted from her ban. Even so, the six largest Wall Street banks, which dominate the derivatives trading business, quickly indicated that they would lobby fiercely to defeat the entire provision."
