By: The Foreclosure Boys Recap In 2005 Tim Dailey was involved in a near fatal hit and run accident that shattered his leg, shoulder and broke parts of his back. Tim went through an extensive and painful rehab, surprising most doctors who diagnosed that Tim would never walk again. After the numerous surgeries and rehabilitation, Tim continued to live each day to the fullest while in unbelievable pain. Andrea and Tim decided to move to Utah in 2006. Excited about Utah, Andrea came up to Utah with her kids while Tim tied up loose ends in California. The day prior to closing on their new home the bank that was providing the loan collapsed. Frantic, Tim found funding from a lending institution in California. Andrea being in Utah was unable to sign with Tim on the loan. The loan and title to the property was listed in the name of Tim Daily only. When Tim settled in Utah he had a doctor recommend to him to continue with his rehabilitation. The doctor felt it best to control the pain by the prescription of high doses of pain, muscle relaxers, and anxiety narcotics. Under the guidance of his doctor Tim began the daily regiment of prescriptions. Tim Daily passed away March 9th, 2009 of heart failure caused by complications with prescription narcotics prescribe by his doctor. Shortly after the funeral Andrea was given notice from the bank that she had no rightful claim to the property. Tim never made a will or set up an estate. Aftermath Support for Andrea has poured in from across the country. Hundreds of people have emailed and plan to attend the court house auction with Andrea and her family at 10:00 AM on the 10th of June in hopes that Bank of America, under these particular circumstances, will consider a fair market equitable solution for everyone involved. Understanding that foreclosure can happen to anybody, The Foreclosure Boys have pledged their support to do whatever they can to help. "The situation with Andrea is not your normal foreclosure procedure." Doug Clark explains. "In this case, Andrea has no legal right to the home, Bank of America technically can't even discuss options because Andrea isn't on the loan." "Here lies the underlining issue. Banks, in all of their wisdom, are unwilling or unable to sell properties at a fair market value but are willing to unload the property at auction for what is often times half of their value, which makes absolutely no sense." Only one option remains for Andrea, an attempt to purchase the property at public auction.
