Will RemoTech make it to Lucky Number 7?

RemoTech files it's seventh patent infringement complaint this week.

March 30, 2010 - PRLog -- RemoTech has fired off yet another lawsuit for patent infringement, this time against Taiwanese corporation Airwaves Technologies Inc. The suit, filed March 24, 2010, comes on the heels of five other patent infringement cases filed by RemoTech citing US patent 4,809,359 (‘359).

The patent in question is titled “System for extending the effective operation range of an infrared remote control system” and was issued in 1986 but expired in late 2006.

According to the statute  35 U.S.C. 284 and 35 U.S.C. 286, the owner of the patent can still sue for patent infringement if they can prove the infringement occurred while the patent was still in-force. The patent owner only has six years after the patent expiration to file a complaint, and damages a plaintiff is entitled to will decrease as time goes by.

According to the complaint RemoTech has its principal place of business is in DeFuniak Springs, Florida. Patent Calls could find no contact information or web address for RemoTech.

Airwaves Technologies is headquartered in the Hsin-Chu Science-Based Industrial Park in Taiwan. The company develops wireless communication, data, video and multimedia products.

RemoTech is asking the court to award increased damages up to three times the amount, and to find Airwave Technologies actions willful and deliberate. RemoTech is also asking to be awarded attorney’s fees and costs.

All parties involved were contacted for comment on the case, none responded by press time.

This is the sixth lawsuit RemoTech has filed in the past two months regarding their ‘359 patent.

In late February, RemoTech filed patent infringement, naming the same ‘359 patent. The suit named Lorex Technology, a Canadian video security company as the defendant.

RemoTech also filed two separate complaints against, Araneus USA and AITech on March 2nd, claiming infringement on the ‘359 patent. The next day -March 3rd- they filed again, this time naming IVS as the defendant.
