Are package holiday claims set to soar in 2010? - Holiday Compensation Experts

Package holiday claims look set to reach new levels in 2010 as package holiday tour operators seem to be putting profits before the safety of their customers.
By: Nick Harris, Head of International Travel Law

Dec. 16, 2009 - PRLog -- Holiday Compensation Claims specialist solicitors Simpson Millar LLP are concerned that big name package travel companies, including leading holiday brand Thomas Cook, are putting their customers at risk of personal injury or illness on holiday thanks to new cost-cutting moves, which could mean a flood of package holiday claims for compensation.

In the week commencing 14 December 2009, Thomas Cook announced a major goal for 2010 is to cut holiday accommodation costs by 5-7%. But for hotels and cruise ships to cut costs when they are already operating on tight margins could mean cutting corners. And that makes personal injury or illness on holiday a real prospect for many UK holidaymakers who may then be entitled to claim compensation.

Nick Harris, Head of Travel Law at Simpson Millar LLP Solicitors, is concerned that travel operators’ moves to squeeze suppliers of holiday accommodation including hotels, villas and apartments could seriously compromise holidaymakers’ safety and lead to an increase in avoidable holiday accidents and holiday illness. Which in turn would lead to an increase in holidaymakers rightfully making a holiday compensation claim for personal injury, holiday illness eg food poisoning and even 'loss of enjoyment' if their holiday if it is ruined through no fault of their own.

"If hotels and other accommodation suppliers are forced to accept price reductions they will have to find means of cutting back to survive difficult, fiercely competitive and seasonal trading conditions" Nick told us.

"It is inevitable that a proportion of accommodation suppliers will run into financial difficulties having just scraped through a recession. Corners will be cut in terms of ensuring basic Health and Safety. For example work to carry out necessary repairs – such as replacing old and worn fixtures and fittings - may be put on hold. I fear it will take tragic incidents to highlight this."

Here at Simpson Millar LLP Solicitors we are braced for an unprecedented level of package holiday claims due to personal injury suffered whilst abroad, holiday accidents and holiday illness in 2010.
