There has been an exponential rise in the number of Federal Agents transitioned to combat white collar crimes in the last 18 months—and they are increasing. The growing financial crisis on Wall Street and the astonishing rise in mortgage and foreclosure fraud has escalated the growth of FBI and other governmental agents being dedicated to battle white collar crimes.


Soon after 9/11, then President George Bush transferred all available FBI agents and governmental resources to anti-terrorism activities. Anti-terrorism was the number one priority of the Bush administration—as it should have been. Unfortunately, this gave rise to an unprecedented increase in white collar crime. Our current economic crisis coupled with the financial scams of Bernard Madoff of the Westgate Capital Fund; Ken Lay, Jeffrey Skilling, and Andrew Fastow of Enron; media baron Conrad Black; Bernie Ebbers of WorldCom; New Jersey fund manager James Nicholson; and media celebrity Martha Stewart have created a wave of public anger and outrage. Now government resources, agents, and unparalleled money are flowing the other way. Special units such as the National White Collar Crime Center, Internet Fraud Complaint Center, National Cybercrime Training Partnership, and the Coalition for the Prevention of Economic Crime have been formed to specifically fight white collar crime.


Mortgage brokers and foreclosure “experts” are at the top of the list. Attorney Generals from every state have stepped up their investigations of loan processors, bank officers, mortgage brokers, and foreclosure assistance companies nationwide. In the month of March, 2009 alone, literally hundreds of guilty pleas were made in Florida, North Carolina, New York, Delaware, Minnesota, California, and Vermont. Unfortunately, unsuspecting “little people” are getting swept up in these investigative nets and are being sentenced to 40 to 70 month federal prison terms.


To make matters even more difficult for white collar criminals, the federal government currently has a 97% guilty plea rate in federal criminal cases. Federal prosecutors have over a 75% conviction rate following criminal trials, and 91% of federal criminal defendants receive a prison sentence. It is no longer a question of will a white collar defendant go to prison, it’s a question of where he will go and how long he will be there.
