July 10, 2008 - PRLog -- Speeding tickets are by far the number one violation of the law citizens of the United States will commit. It isn’t always on fault. There are a lot of reasons some one might drive over the speed limit. You may not know the speed limit, you may have your mind on something else, or you might be in a hurry and just not care what the speed limit is. Whatever the case, we will all get one at some point in our lives.

Speeding ticket fines average around $300 per ticket. Get caught in a construction or school zone and you can double that. These outrageous fees go to the cities or states to help pay for the police who will in turn dish out more speeding tickets.

Most people accept the fact that it is pointless to try and fight a speeding ticket. After all, it is your word against the cop in front of a judge who is familiar with him. The judge is going to almost always side with the cop.

It is possible to fight a ticket successfully. Here is how you go about defending yourself against this violation, even if you were speeding.

1. Go to court - Really, you can’t defend yourself if you do not show up to court. Make sure if you decide not to go to court to be sure to pay the ticket ahead of time. They will come after you and it will not be pretty.

The reason you need to go to court is because the ticketing officer must be there to point the finger at you. If he doesn’t show up due to work hours or vacation, you will walk free. You can call the station at various times leading up to the trial and ask to speak to the officer. Make a list of when the officer is in and when he is not, then try to get the court date moved to one of those times the officer is not in. At least make it a pain for him to accuse you.

2. Ask for Radar calibration- You can request documentation that the radar had been properly calibrated prior to the time you received your ticket. You can ask for all calibration records to see if the radar had been properly calibrated over a long period of time. If the officer fails to show this, you have a great defense. If he brings the documentation, look carefully for inaccuracies in the records.

3. Ask for independent recollection- Independent Recollection is where the officer must be able to describe you and the surroundings of the day he gave you the ticket. He cannot look at notes or ticket during the trial. Simply object if you catch him doing so, then ask for details of what you were wearing or weather conditions. This works great. You can really throw the cop off his game.

These tips will help you defend yourself from a speeding ticket. If you were innocent, then fight for your innocence. You can successfully defend yourself if you do a little research and be prepared in court.
