Scott Wolfe Jr. Presents The Subcontractor’s Guide to a Fair Lien Waiver Process

“The lien waiver document was supposed to be simple.  It was supposed to be a receipt,” Wolfe wrote in the Construction Payment Blog (http://www.zlien.com/articles/ultimate-guide-to-lien-waivers/). “A waiver of lien rights exchanged for a payment. Now, however, it’s a hot mess of legal traps and nuances. Some states regulate it and some states don’t, and because the regulations are complicated in themselves, it’s tough to decide which is a worse fate.”

Lien waivers originated with good intentions, intentions bearing a fair trade of payment in return for a promise of not filing a mechanics lien on the property where work was performed.  Unfortunately are often used to take advantage of company’s with construction roles down the chain. Instead of being asked to sign a lien waiver upon payment, general contractors, property owners and other similar parties, will present the lien waiver with the construction contract. Wolfe will identify the dangers of signing a lien waiver at the start of a construction project, as well as the language obstacles that lie within in a wordy lien waiver.
