The American Recovery and Reinvestment Act (ARRA) of 2009, in Section 13411 of the HITECH Act requires HHS to conduct periodic audits to ensure that Covered Entities and Business Associates comply with the HIPAA Privacy and Security Rules and Breach Notification standards. According to its recent report, nearly two-thirds of the breach happened are by the Business Associates.
