According to the verified complaint initiating the lawsuit, in 2006, ESB had initiated court proceedings against Sayeh Sassouni to foreclose on her home in Kings Point. The Cougentakis complaint further alleges that Sayeh Sassouni conspired with her father Nejatollah to take over ESB’s position and to have Nejatollah, through a front-company (TOLA New York Enterprises) The lawsuit requests the court enter a judgment in the amount of the $3.9 million now owed on the promissory note and impose a statutory and equitable lien on the Kings Point property because Nejatollah Sassouni’s foreclosure was a sham and illegal fraudulent conveyance. According to the allegations in the verified complaint, Sayeh Sassouni has accumulated judgments worth hundreds of thousands of dollars against her for bad debts beyond the nearly $4 million claimed in this lawsuit. In fact, in a separate lawsuit, Shahriar Homapour, another Kings Point resident, obtained a judgment against Sayeh Sassouni for close to $300,000 for monies she borrowed and promised to pay back but did not.
