NEW YORK - June 24, 2015 - PRLog -- The Incident which is the subject of the Complaint took place at about 10 p.m. on June 10, 2015, on Howard Avenue, between Hancock Street and Jefferson Avenue, Brooklyn, NY.

Nashiem was standing on a public street, talking to his girlfriend on the phone, when an unmarked police vehicle pulled up to the curb, close to where he was standing. The NYPD Officer driving the vehicle asked Nashiem, “What are you doing outside?” and he responded that he was on the phone. The NYPD Officer driving the vehicle then asked him if it was okay to “check” him and he reluctantly agreed to be “checked.”

The NYPD Officer who had been driving and two other officers then got out of the vehicle and the officer that had been driving grabbed the front of Nashiem’s belt, above his groin area, instructing the other officers to “cuff” him. Nashiem then asked why he was being arrested and two of the officers told him that he “knew what he did.”An NYPD Officer then punched Nashiem in the ribs, and he was then continually punched in the ribs and torso region, eventually being handcuffed excessively tightly. In agony from the beating, Nashiem started screaming, “What am I being arrested for?” and was told by one of the NYPD Officers to “Shut the ____ up. He was then placed in the back of the unmarked NYPD car, with his hands cuffed behind his back, and one of the officers continued to punch him in the side of his torso region and pulling on his handcuffed hands by the cuffs, which left marks on his wrist.

Once at the 81st Precinct, Nashiem was informed that he was being arrested for sale of narcotics. He was then subjected to a degrading strip search, which included the officers placing a flashlight at his anus, which left him humiliated and feeling violated. The officers then told Nashiem that if he gave them the drugs, they’d let him go, but Plaintiff did not have any drugs to give them. He was eventually transported to Central Booking to await arraignment. Once before a Criminal Court Judge, Nashiem learned that he had not been charged with selling narcotics as the officers had told him, but rather, charged solely with Resisting Arrest.

At arraignment, the matter was adjourned in contemplation of dismissal, ACD. Within his false arrest Complaint, Nashiem makes claims for the unlawful detention he suffered, loss of liberty, emotional distress, fear, anxiety, humiliation, degradation and suffered physical pain- all to his detriment.
