Holiday pay compensation to be capped from 30 June 2015

June 10, 2015 - PRLog -- 30 June 2015 is the deadline for employees to seek up to six years compensation for incorrectly paid holiday pay.

Most companies base holiday pay on basic pay. However, for many employees overtime, commission and bonuses make up a substantial part of their weekly pay. This means that when they go on holiday they take a drop in pay. The European Working Time Directive states that holiday pay should be based on normal pay, so that staff shouldn't receive less money when on holiday. It requires companies to take an average of the last 12 weeks earnings, to calculate their holiday pay.

John MacInnes who put together the Holiday Pay Compensation information site stated: “There are a lot of people who are misinformed about how much holiday pay they are actually entitled to. The principle is that you should not receive less pay when you are on holiday than you would normally get – if you have received less then you may be entitled to compensation. Recently the government introduced legislation restricting back pay claims to two years from 1 July 2015. If people are in the process of claiming, they need to remember that the deadline for claiming up to six years back pay is 30 June 2015.
