Actress wins hearing overturning initial decision claiming intentional misrepresentation

NEW YORK - April 29, 2015 - PRLog -- Attorney Steven Fingerhut, an associate of the law firm Imbesi Law PC, successfully represented an employee in response to a determination by the Department of Labor that the employee made "willful false statements" in order to obtain insurance benefits.  The Department of Labor demanded repayment of all benefits received.

The Honorable Wendy Pichardo issued an award, in favor of the firm's client, after an in-person hearing. The decision overruled a determination by the Department of Labor that the employee willfully made false statements in order to obtain benefits.

Specifically, the decision set forth the following:

DECISION: The initial determinations holding the claimant ineligible to receive benefits, effective January 13, 2015...are overruled.

The claimant is allowed benefits with respect to the issues decided herein.
